These Clearyst Connect LLC (dba "Marlimar Communications" or "Marlimar) Terms and Conditions (the "Terms") govern the use of Marlimar products and services by you ("Customer" or "Customer's") and incorporate by reference 96714 Short Code Terms and Conditions. By using or accessing, or by acquiring the products or services, Customer and Customer's authorized users accept and agree to these Terms and all other applicable terms and conditions, policies, or disclaimers.

96714 Short Code T&Cs

Ford FDAF is a standard-rate SMS and MMS program which provides subscribers recurring coupons and offers specific to Ford automotive. Message and data rates may apply. By opting into Ford FDAF, end-users agree to receive pre-written marketing messages from or on behalf of Ford FDAF via short code 96714 and understand that consent is not a condition of service.

General Description

Marlimar Communications is a mobile communications service company. We provide technology services and intellectual property to various entities facilitating communications to permissioned subscribers via Short Message Services (SMS or "text messaging") offered by independent communications companies, email providers utilizing standard Internet protocols. The delivery of messages to and from our system is not guaranteed by Marlimar, mobile operators, messaging aggregators, Internet providers, or other organizations. Use of our systems for emergency services is strictly prohibited. The websites are developed by Marlimar. The software used to build, deploy, and provide these services are the intellectual property of their respective authors and are protected by open-source copyrights or patents. Marlimar makes no claims of copyrights, patents, suitability beyond the limited terms of their respective agreements. By using our websites, you agree that you are at least thirteen (13) years of age and are bound by this Agreement. Parts of our website and/or services may require subscribers to be at least 18 or 21 years old depending on content. The user of these services agrees to furnish the system with accurate information regarding their age. Marlimar is not responsible for content provided to recipients with inaccurate or erroneous birthdate information. The misrepresentation of age to use such services is a violation of Federal Law. The users agree to indemnify and hold harmless Marlimar for any misuse or misinterpretation of CTIA.org, Mobile Marketing Association (MMA) or Federal Communications Commission (FCC) laws, regulations, or practices. Content transmitted to and from our system is the sole responsibility of the content originator of the messages. Any content submitted to our system is deemed to be provided "as-is" and becomes the property of Marlimar and is subject to our Privacy Policy.

Acceptable Use

Users agree not to use the services to transmit unlawful, abusive, harassing, libelous, deceptive, or otherwise inappropriate content. Prohibited uses include but are not limited to unsolicited marketing, phishing, spoofing, or sending malware or harmful code.

Service Availability

The services may occasionally be unavailable due to reasonable maintenance, outages, or factors beyond our control. No guarantees are made as to uptime or uninterrupted delivery.

Ownership of Data and Feedback

All data, feedback, suggestions, or other content submitted by users in connection with the products and services, including but not limited to feature ideas, error reports, or performance observations, will be the sole and exclusive property of Marlimar and its assigns, without any obligation to compensate the user.

Fees, Rates, and Costs

All messaging to subscribers is provided without additional charges. Mobile operator, Internet, and email providers consumed by subscribers are subject to the Terms and Conditions for their respective providers. Standard messaging and data rates apply as set forth in their provider agreements.

Disclaimers

Under no circumstances will Marlimar any of our websites be liable to you for any damages or losses including, without limitation, direct, indirect, exemplary, special, consequential, incidental, or punitive damages resulting from, or caused by, the Site, the Software, the Content, the Agreement, or otherwise (including, without limitation, damages resulting from negligence). Our websites are not responsible for lost revenues, profits, business, information, photos, or data, even if we are advised beforehand of the possibility of such losses or damages. In no event will the aggregate maximum liability of the Marlimar for any claim ever exceed 1/100 of 1 cent ($0.0001). You agree to indemnify and hold harmless Marlimar and the Site from events that may arise out of your use of the Site, including without limitation any listing and/or advertisement that is placed, found, or used on the Site. Marlimar does not agree with or endorse the statements, claims, or messaging provided in the content or related websites and do not make any claims of ownership of copyrights or patents for content provided by our clients. We are not responsible for content errors omission, typographic, or otherwise. T-Mobile is not liable for delayed or undelivered messages.

Changes to Terms

We may update these Terms periodically and continued use of the services after notice of changes constitutes your acceptance of the updated Terms.

Assignment and Continuation of Terms

All rights and obligations under these Terms will automatically transfer to any successor or acquirer of Marlimar without the need for additional consent from end-users. Your continued use of the services following such transfer will constitute your acceptance of the new provider's continuation of these terms.

Consent Records

Users are responsible for maintaining proof of subscriber opt-in consent as required by applicable regulations, including the TCPA and CTIA guidelines.

Compliance with Law

You agree to use the services in compliance with all applicable laws and regulations, including those governing data privacy, marketing communications, and consumer protection.

Suspension and Termination

We reserve the right to suspend or terminate access to the services at any time for violations of these Terms or applicable law, or to maintain the integrity and security of the platform.
